A molestation case involving a 9-year-old girl. The victim's mom appealed to the Ombudsman (Akyikatchy)
The mother of a 9-year-old girl who was molested by a neighbor is asking for the public's help. She's now trying to defend her daughter's rights in court, but she is under intense pressure.
Woman A. T. in despair came to a personal appointment with Akyikatchy (Ombudsman) of the Kyrgyz Republic Dzhamilia Dzhamanbaeva. She told that from all she is under pressure from all sides.
"The trial is dragging on, out of the seven trials five sessions because the defendant was not brought to court. Then the judge went on vacation. With every trial canceled, I can't even go to work, and I'm the sole breadwinner in this family. I also have to pay for a lawyer. And the process just keeps dragging on and on. I've got all the dogs on me - the other neighbors are hounding me, they're throwing dirt on me and my daughter with dirt. Every day different provocations from their side, it comes to the point where they're filing a report against me. They are trying to make us outcasts. I just want to protect my daughter and get justice so that the guilty party to get what he deserves. What can I do? I need protection, help...", - the woman cried from despair and pain.
We would like to remind you that the Sokuluk District Court is currently considering a criminal case of harassment against a 9-year-old girl. According to the materials of the case against M.A. (neighbor), a criminal case was initiated under Article 158 of the Criminal Code of the Kyrgyz Republic.
On February 6, 2023, A. T., after learning from her 9-year-old daughter about the molestation by a neighbor, she filed a report with the police. A comprehensive examination confirmed that the girl had told the truth about the fact of about being molested by the man. Earlier in the media, the girl's mother told how she learned about the harassment. According to her daughter cried and asked not to leave her at the neighbors when she said her daughter cried and asked not to leave her at the neighbor's house when she went to work, as the neighbor kissed her all the time and it made her sick.
Later, according to the mother, the girl gave other details, how the a neighbor came to the room where she was sleeping at night, undressed and touched her.When the girl cried, he went into another room, afraid that his wife and children might wake up. The girl's mother, having learned about it, wrote a report to the police.
The staff of the Department for the Protection of Children, Women and Family Rights has been working on this case since from the very beginning of the criminal case - they provided legal counseling to the mother of the girl. In addition, for all offenses during the investigation, the institute applied to law enforcement agencies and the prosecutor's office.
Akyikatchy Dzhamilia Dzhamanbaeva calls on the relevant government agencies to ensure the protection of the girl's rights in court. In particular, Akyikatchy appealed to the leadership of the State Penitentiary Service to ensure escort the accused from the pre-trial detention center to the court.
The Ombudsman also calls on other lawyers to help the girl's mother to defend the girl's rights in court to defend the girl's rights. The next court hearing is scheduled for August 14. The trial is held in closed mode.
